The Black Scholar Fund, Inc. Privacy Policy

This website, located at www.theblackscholarfund.org (the “Site”), is owned and operated by The Black Scholar Fund, Inc. (the “Foundation,” “we,” “us”), a nonprofit tax exempt corporation, existing under the laws of the State of New Jersey. Your privacy is important to us. This Privacy Policy (the “Privacy Policy”) outlines the type of Personally Identifiable Information (as defined below) that we may collect while you are visiting the Site, as well as ways in which we process and disseminate such Personally Identifiable Information. This Privacy Policy is part of and incorporated into the Siteʼs terms of use (“Terms of Use”), which is the contract between you and the Foundation governing use of the Site. Parts of the Terms of Use affect this Privacy Policy, so please review them prior to using this site. The Foundation cannot and does not assume responsibility for the policies, practices and actions of third parties. You are, of course, free to use much of the Site without providing any Personally Identifiable Information to us.

The Foundation makes no representation that this Site is governed by or operated in accordance with the laws of other nations. By using this Site, visitors from outside of the United States of America acknowledge this Site is subject to the laws and regulations of the United States of America, and waive any claims that may arise under their own national laws. The Foundation reserves the right to change, modify, add or remove provisions of this Privacy Policy. We also encourage you to check back from time to time to ensure continuing familiarity with the most current version of our Privacy Policy. Please read this Privacy Policy carefully. Your use of this Site constitutes your acceptance to be bound by the Privacy Policy without limitation, qualification or change. If at any time you do not accept all the terms and conditions contained herein, you must immediately discontinue use of this Site.

  1. Information We Collect

    • Contact Information: For example, we may collect your name and street address. We may also collect your phone number or email.

    • Payment and Billing Information: For example, we collect your credit card number and zip code in the event you donate to the Foundation.

    • Demographic Information: We may collect information about you for the purposes of surveys.

  2. How Information We Collect Is Used​

    • Non-Personally Identifiable Information (“Non-PII”): May be used to measure the number of visits, average time spent on the Site and pages viewed as well as to diagnose problems with our servers and to administer the Site. We may then use this information to analyze and improve the features and functionality of this Site. In addition, we may share information with third parties that are not part of the Foundation on an aggregate or other basis that does not disclose any of your PII (defined below).

    • In some instances, we may combine Non-PII with PII (such as embedding email addresses in cookies). If we do combine any Non-PII with PII, the combined information will be treated as PII as long as it is so combined. This “combined” PII is not shared with third parties, except as described in this Policy.

    • Personally Identifiable Information (“PII”): When you supply information about yourself to make a donation, we use the information solely for that purpose. We may enter the PII into our donor database and contact you in order to supply you with information, including Foundation newsletters, program updates, events and fundraising opportunities. We do not share this information with outside parties except to the extent necessary to complete the transaction or ship the purchased item. Please note that, at times, forms on the Site may be pre-populated with your PII in order to facilitate a transaction between you and the Site.

    • The Foundation reserves the right to notify you of administrative matters in connection with the Site (e.g., contacting you to facilitate, complete or confirm a transaction). Because this information may be important to your use of the Site, you may not opt-out of receiving such communications. 

    • You Have Certain Choices About How We Use Your Information: You can control cookies and tracking tools. This may be managed by adjusting your browser settings so that you can refuse cookies. 

  3. How Personally Identifiable Information We Collect Is Disclosed

    • Compliance With Applicable Law: The Foundation may access and disclose PII as needed to: (1) comply with applicable laws; (2) respond to governmental inquiries or requests; (3) comply with valid legal process; (4) protect the rights, privacy, safety or property of the Foundation, Site visitors or the public; (5) permit us to pursue available remedies or limit the damages that we may sustain; and (6) enforce our Terms of Use or other published guidelines.

  4. Collection Of Information By Third Parties

    • Co-Branded Pages: We may enter into relationships with “powered by” partners, business partners, sponsors, and co-branded sites (referred to here as “CoEffective Branded pages”). These might include, for example, pages that share our name and that of another entity. You should look for a specific privacy policy on any such Co-Branded page. Any PII that you provide when signing up at any cobranded page may be collected by, or shared with, our third-party partner. We have no control over, and are not responsible for, our partners’ use of your PII. You should check our posted partners’ websites for information regarding their privacy policies.

    • Transactions With E-Commerce Partners, Vendors and Advertisers: When you provide PII to one of our Site’s e-commerce partners, vendors or advertisers, this transaction will occur in connection with the site of the e-commerce partner, vendor or advertiser, not on the Site, and, as such, the PII you provide is collected pursuant to and controlled by the privacy policy of such e-commerce partner, vendor or advertiser. The Foundation is not responsible for such parties’ privacy policies and we encourage you to familiarize yourself with the applicable privacy policy of the e-commerce site with which you transact business or to contact the operator of such site for more information. Please be aware that at times, at the request of or on behalf of our e-commerce partners, vendors or advertisers, the Foundation may “pre-populate” forms with your PII for your review. Accordingly, we encourage you to review each pre-populated form carefully before agreeing to submit your PII to determine who is seeking to collect your information, and to familiarize yourself with the applicable privacy policy governing use of any PII collected about you.

    • Third Party Links: The Site may contain links to third-party Internet websites, which are not owned or operated by the Foundation. We provide such links only as a convenience, and the inclusion of a link on the Site does not imply endorsement of the linked site by the Foundation. If you provide any PII through any such third-party website, your transaction will occur on such third party’s website (not the Site) and the PII you provide will be collected by, and controlled by the privacy policy of, that third party. We are not responsible for the privacy practices or the content of such third-party websites, including such websites’ use of any PII that you provide to them. We strongly encourage you to become familiar with the privacy practices of those sites.

    • PLEASE NOTE THAT THIS POLICY DOES NOT ADDRESS THE PRIVACY OR INFORMATION PRACTICES OF ANY THIRD PARTIES.

  5. Updating Or Deleting Information Collected About You

    • If you would like to update or delete the information we received from you, you may contact us directly at legacy@theblackscholarfund.org. The Foundation endeavors to keep your PII accurate and up to date. If your PII has changed, you may submit your new information there as well. We keep PII for as long as we think it is necessary or advisable and reserve the right to retain such information to the full extent not prohibited by law. We may discard your PII in our discretion, so you should retain your own records and not rely upon the Foundationʼs storage of any PII or other data.

  6. Security Of Your PII

    • The Foundation employs reasonable security measures consistent with standard industry practice, for PII collected through this Site, including physical, electronic and operational measures to maintain security and prevent unauthorized access. While the Foundation takes all appropriate steps to safeguard PII under our control, unfortunately, no data transmission over the Internet or method of storing data can be guaranteed to be 100% secure. As such, we cannot guarantee that PII supplied by users will not be accessed on our servers, or intercepted while being transmitted to us over the Internet. We assume no liability for any damages you may suffer as a result of interception, alteration or misuse of information during such transfers. If you have reason to believe that there has been any breach of the security of the Site, please contact us at legacy@theblackscholarfund.org. You will be responsible for all uses of your donation, whether or not authorized by you. You agree to immediately notify the Foundation of any unauthorized use of your PII at legacy@theblackscholarfund.org. If we are required to provide notice of unauthorized access or other invasion of certain security systems, you agree that we may do so when required or (voluntarily) by posting notice on our Site or sending notice to any email address we have for you, in our good faith discretion. You agree that notice to you will count as notice to others for whom you are acting on behalf of and agree to pass notice to them.

  7. Offline VS. Online Practices

    • Please note that this Privacy Policy applies solely to our online information gathering and dissemination practices in connection with the Site, and does not apply to any of our practices conducted offline.

  8. Contacting The Black Scholar Foundation Regarding This Site

    • If you have any questions concerning this Policy, you may send them by email to legacy@theblackscholarfund.org. Please note that email communications will not necessarily be secure; accordingly you should not include sensitive information in your email correspondence with us.

  9. Children

    • We do not want to collect information from children. Do not provide any PII unless you are at least 13 years of age. If any child under 13 has provided any PII, a parent may so inform us by writing us at our address set forth below, and we will use commercially reasonable efforts to delete such information from our database, subject to applicable law and this Privacy Policy.

  10. Access To Your PII

    • We appreciate your assistance in keeping your PII up to date and accurate. You are entitled to verify update your PII collected by the Foundation. If you have a concern regarding the collection, use or disclosure of your PII by the Foundation, please contact us at legacy@theblackscholarfund.org and your concern will be investigated and you will be notified as soon as possible of the outcome of the investigation and any action required as a result.

11. Amendments

  • This policy describes our current policy, but may change from time to time. We may further amend all or part of this policy in the same way that we make amendments to our terms of use and such amended versions will be posted on this page.
